1. Agreement to Terms

By accessing or using the website, platform, and services provided by Ministry Marketing LLC d/b/a Church Posting ("Company," "we," "us," or "our"), you ("Client," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree, do not use our services.

2. Services Overview

Church Posting provides church-focused local SEO, Google Business Profile optimization, CRM and communication tools, sermon clip editing, Google Ad Grant management, website building, social media scheduling, and related services as described on our website and in individual service agreements.

3. Eligibility

You must be at least 18 years of age and authorized to act on behalf of the church or organization you represent. By subscribing, you confirm that the information you provide is accurate and that you have the authority to enter into this agreement on behalf of your organization.

4. Account and Access

When you create an account with Church Posting, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We are not liable for losses caused by unauthorized use of your account.

5. Subscription and Billing

Church Posting services are offered on a month-to-month subscription basis unless otherwise specified. By providing payment information, you authorize us to charge the applicable subscription fee to your chosen payment method on a recurring basis.

We reserve the right to change pricing with 30 days written notice. Continued use of the service after a price change constitutes acceptance of the new pricing.

6. Communication Credits (Texting and Email)

CRM accounts include $10 in starter credits that apply to SMS/text messaging and email sending. Once starter credits are used, texting and email operate on a pay-as-you-go basis. Credit balances and usage rates are visible within your account dashboard. Unused credits do not expire but are non-refundable.

7. AI Add-On

AI features (including AI-generated pages, workflows, automations, content, and images) are available as a separate $200/month add-on and are not included in the base CRM or SEO plans. AI capabilities are subject to third-party provider availability and may change without notice.

8. SEO Services and Guarantee

Church Posting offers a 90-day guarantee for Google Maps visibility. If your church does not appear in the top 3 of the Google Map Pack for your target area within 90 days, we will continue working at no additional cost until that result is achieved. This guarantee applies to the specific geographic service area and keywords agreed upon at the start of service.

SEO results depend on many factors outside our control, including Google algorithm changes, competitor activity, and the accuracy of information you provide. We do not guarantee specific organic search rankings, website traffic levels, or conversion rates beyond the stated Map Pack guarantee.

9. Sermon Clip Services

If you subscribe to sermon clip services (included in the City plan or available standalone), you grant us permission to access, download, edit, and distribute clips from your recorded livestream content. Clips will be edited with captions and your church branding and scheduled for posting with your approval. It is your responsibility to ensure that your livestream content does not infringe on any third-party copyrights.

10. Google Ad Grant Management

Google Ad Grant management is included free with the City plan, or available as a $497/month add-on. We assist with application, campaign setup, compliance, and optimization. The Google Ad Grant program is administered by Google, and eligibility, approval, and continued participation are subject to Google's policies and requirements. We do not guarantee approval or continued eligibility for the Google Ad Grant.

11. Third-Party Integrations

Our platform may integrate with third-party services including but not limited to Google, Facebook, Instagram, and payment processors. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the availability, performance, or policies of third-party services.

12. Client Responsibilities

You agree to provide accurate information about your church, maintain active social media and platform connections as needed, respond to approval requests in a timely manner, and comply with all applicable laws regarding communications sent through the platform (including but not limited to the Telephone Consumer Protection Act for text messaging).

If the connection to any social media account or third-party integration is broken, disabled, or deleted, it is your responsibility to re-establish the connection. We are not responsible for content that fails to post due to disconnected accounts.

13. Intellectual Property

All content, branding, and materials created by Church Posting (including website designs, SEO strategies, graphics, and written content) remain the intellectual property of Ministry Marketing LLC unless explicitly transferred in writing. You retain ownership of your church's name, logos, sermon content, and any original materials you provide to us.

14. Cancellation

You may cancel your subscription at any time by contacting us at hello@churchposting.com or by calling 785-620-1811. Cancellation takes effect at the end of the current billing cycle. No refunds will be issued for partial billing periods. Upon cancellation, access to the platform and associated data may be removed after a 30-day grace period.

15. Limitation of Liability

Ministry Marketing LLC and its directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, or expenses (including legal fees) arising from your use of the service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the three months preceding the claim.

16. Indemnification

Except where prohibited by law, by using this service you agree to indemnify and hold harmless Ministry Marketing LLC and its directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of our service or your violation of these Terms and Conditions.

17. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Hillsborough County, Florida. You agree to waive any right to a jury trial or to participate in a class action.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

19. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the service after changes are posted constitutes acceptance of the revised Terms.
